Winn-Dixie Web Access ADA Case Brought by Blind Shopper Vacated

A federal appeals court decision saying websites aren’t covered by the Americans with Disabilities Act will be vacated after the Eleventh Circuit found Tuesday that the appeal filed by a blind Winn-Dixie Stores Inc. customer is moot.

Juan Carlos Gil sued Winn-Dixie in 2016, alleging he was unable to use the store’s website to refill his prescriptions because the site wasn’t compatible with his screen-reading software. Gil won a bench verdict and an injunction requiring the chain to make its website accessible for three years.
