Winn-Dixie Avoids Suit by Blind Customer Who Can’t Use Website

A verdict in favor of a visually impaired customer of Winn-Dixie Stores Inc., who claimed he was discriminated against in violation of the Americans with Disabilities Act because he couldn’t use the store’s website, was vacated by the Eleventh Circuit.

Juan Gil said that because the website was incompatible with his screen reader software, he couldn’t use it to refill his prescriptions. He claimed that the website was a public accommodation under the ADA and that he was denied access to the store’s services because of his disability.
