Welch’s Fruit Snacks Beats Claim Over Use of ‘Puree’ on Label

Listing “fruit puree” as the first ingredient on Welch’s Fruit Snacks doesn’t violate federal law because the term is commonly used in the industry to describe groups of similar ingredients, a California appeals court said Tuesday.

Thomas Iglesias sued Promotion in Motion Inc., which manufactures and distributes fruit snacks under a license from Welch Foods Inc., alleging violations of the California Legal Remedies Act and the state’s unfair competition law. Iglesias said he regularly purchased the fruit snacks based in part on the label’s representation that fruit is the first ingredient.
