A trade association that represents U.S. air carriers failed to convince the Ninth Circuit that Washington’s paid sick leave law shouldn’t be applied to its members.
The Washington PSL isn’t preempted by the Airline Deregulation Act and doesn’t violate the dormant commerce clause, the unpublished memorandum said.
Under the PSL, employers must provide Washington-based employees at least one hour of paid sick leave for every 40 hours worked. The law also prohibits employers from penalizing employees for using sick leave or requiring medical verification for sick leave absences of less than three days.
