Volkswagen Wins Appeal to Intervene in FOIA ‘Dieselgate’ Case

Volkswagen AG can intervene in a lawsuit by a Loyola Marymount University professor who seeks information about the company’s “dieselgate” emissions scandal, the Ninth Circuit said in a reversal of a trial court’s ruling.

The Department of Justice sent a notice to VW’s counsel about Lawrence Kalbers’ suit on Sept. 4, 2019. Volkswagen moved to intervene in the Freedom of Information Act case Sept. 27, 2019. The U.S. District Court for the District of Central California said the company should’ve moved to intervene as soon as it learned of the lawsuit.
