Visa Seekers Win Review of Claims Over DHS Application Delays

The Trump administration failed to shake off claims of dragging its feet on processing U visa applications for victims of serious crimes who cooperated with law enforcement, after the Fourth Circuit found Thursday that the allegations of unreasonable delay were sufficient to survive dismissal.

The plaintiffs alleged “sufficient facts to show that their interests are weighty, implicate health and welfare, and are harmed by the long wait,” the U.S. Court of Appeals for the Fourth Circuit said.

But the plaintiffs can’t go forward with claims that the government delayed adjudication of their applications for work authorization pending U visa approval ...
