A vaping industry trade group is challenging as unconstitutional a new North Carolina law that directs its revenue department to penalize manufacturers of vaping products that haven’t received marketing authorization from the Food and Drug Administration.
The lawsuit filed Wednesday with US District Court for the Eastern District of North Carolina alleges that beginning June 29, the Vapor Technology Association’s manufacturer, distributor, and retailer members will be unable to sell many of their products in the state, and that co-plaintiff vaping retailers and distributors likewise won’t be able to sell or distribute e-cigarettes, also known as electronic nicotine delivery systems ...
