Utility Gets $53 Million in Nuclear Waste Dispute

A federal appeals court June 10 reinstated an award of $53.2 million to the Sacramento Municipal Utility District over the Energy Department’s failure to provide a long-term nuclear waste storage facility (Sacramento Mun. Util. Dist. v. United States, 2014 BL 171919).

The U.S. Court of Appeals for the Federal Circuit reinstated a prior judgment covering the storage of spent fuel rods up through Dec. 31, 2003, and ordered the Energy Department to execute the payment immediately.

The court also vacated the award from 2004-2009 and remanded that part of the decision for further consideration.
