Supreme Court Broadens Judicial Review in Deportation Cases (1)

The Supreme Court said federal courts can review decisions from immigration judges who reject claims brought by those seeking to avoid deportation due to unusual hardships it would cause family members in the US.

In a 6-3 decision on Tuesday that cut across ideological lines, the justices said the US Court of Appeals for the Third Circuit erred in holding that it lacked jurisdiction to review an immigration judge’s determination.

Writing for the majority, Justice Sonia Sotomayor said applying the legal standard for exceptional hardship to an established set of facts is a quintessential mixed question of law and fact. ...
