Union Pacific Railroad Co was denied its motion to dismiss a proposed class action alleging the company violated Illinois’ Genetic Information Privacy Act when it asked potential employees for their family medical history.
Candace Taylor and Carla Moreno both alleged that their employment was conditioned on giving a Union Pacific medical provider their family medical history during a pre-employment physical, according to the opinion from the US District Court for the Northern District of Illinois. The duo brought a claim under GIPA Section 25(c)(1), alleging Union Pacific solicited, requested, or required family medical information as a condition of employment.
