Unanimous SCOTUS Halts Ban on ‘Immoral’ Trademarks

Yesterday the justices struck down a federal prohibition on registering “immoral” or “scandalous” trademarks.

Favoring Speech: In a 9-0 opinion, the justices said the federal government can’t disfavor certain speech just because it doesn’t like it.

F-U-C-T: The ruling is a win for Erik Brunetti, whose clothing line F-U-C-T was denied registration because—as the federal government’s lawyer said at oral argument—it is “the equivalent of [the] past participle form of a well-known word of profanity.”
