UCF Speech Code First Amendment Challenger Scores Injunction

A nonprofit group will advance its attempt to block two speech-related policies at the University of Central Florida, after the Eleventh Circuit said Thursday that one policy likely violates the First Amendment.

UCF’s discriminatory-harassment policy prohibits “verbal, physical, electronic, or other conduct” based on a number of criteria, including an individual’s race, religion, sex, disability, or political affiliations.

It also bars students from “condoning or encouraging” or “failing to intervene” to stop such acts. The school’s bias-related-incidents policy creates a procedure by which students may be anonymously reported for committing an act of hate or bias.
