The Commerce Department must reconsider the U.S. duty rate on imports of steel nails from Taiwan, after the Federal Circuit said Thursday that the Commerce Department once again failed to justify its statistical methodology for finding “targeted dumping.”
The U.S. in 2015 imposed antidumping duties on certain Taiwanese steel nails. The Commerce Department calculated a dumping margin and corresponding duty rate of 2.24% for PT Enterprises Inc. This rate was then applied to most other Taiwanese producers and exporters that weren’t individually examined by Commerce.
