Trump Pardonee Sees Habeas Petition Revived by Tenth Circuit

Clint A. Lorance can pursue habeas relief to restore his military rank because his acceptance of a presidential pardon didn’t amount to a legal confession of guilt to his underlying crimes, the Tenth Circuit said Thursday, reviving the former first lieutenant’s petition for habeas relief.

Lorance, who was convicted of murder in connection with the killing of two Afghans in 2012, was released from custody following a presidential pardon from former President Donald Trump in July of 2020.

The pardon only secured Lorance’s release; it didn’t restore his rank, back pay, or veteran benefits.
