The Trump administration can ban transgender individuals with gender dysphoria from serving in the military pending litigation, the D.C. Circuit said.
The Secretary of Defense undertook an in-depth analysis on the ban and concluded that it would advance military cohesiveness, Judge Gregory G. Katsas said Tuesday for the US Court of Appeals for the District of Columbia Circuit. The secretary’s decision should be afforded deference, Katsas said, staying the district court’s “contrary assessment of the evidence.”
