TikTok Seeks Full Circuit Rehearing of ‘Blackout’ Challenge Suit

TikTok Inc. asked the entire Third Circuit to reconsider an August ruling that it said renders “the 26 words that built the Internet a nullity.”

A panel of judges from the US Court of Appeals for the Third Circuit previously said the social media company must face a lawsuit from the family of a 10-year-old who died after participating in a challenge the platform promoted, finding a federal internet shield doesn’t apply.

The ruling—that the shield doesn’t extend to suits against websites over “editorial judgments” to promote third-party content—should be heard by all the members of the Philadelphia-based appeals court, ...
