Thomas Targets Nationwide Injunctions in Travel Ban Opinion

Justice Clarence Thomas took the opportunity June 26 to highlight the dangers of “nationwide injunctions” in his concurring opinion backing President Donald Trump’s travel ban.

A federal district court judge can stop a law or policy from going into effect on a nationwide basis in a single case. The practice has been used to halt President Barack Obama’s policy deferring deportation for Dreamers, as well as by a federal judge in Hawaii who put the brakes on Trump’s travel ban.
