Parts of the strictest abortion law in the nation—including one that gives more than 21 million Texas adults the ability to sue providers—are unconstitutional, a Texas state judge said.
A Texas S.B. 8 provision giving “any person” standing to sue anyone who allegedly performed or aided an abortion after six weeks’ gestation violates the Texas Constitution’s open courts provision, Judge David Peeples said. Peeples is sitting by designation in the Texas District Court of Travis County.
