Texas Death Row Inmate’s Sentence Thrown Out

A Texas death-row inmate’s sentence for double murder has been vacated by the U.S. Court of Appeals for the Fifth Circuit (Buck v. Davis, 5th Cir., No. 14-70030, 4/13/17).

Duane Buck, 53, ultimately could be released after spending two decades in prison following a U.S. Supreme Court decision on Feb. 22 requiring the Fifth Circuit to overturn his sentence. He was convicted in the 1996 shooting deaths of his ex-girlfriend, Debra Gardner, and her friend, Kenneth Butler, in Houston.
