Texas Court Nixes ‘Wrongful Pregnancy’ Claim in Malpractice Case

A Texas woman who became pregnant after she had paid for, but didn’t receive, a tubal ligation convinced a state appeals court to revive her lawsuit, but she can’t recover costs related to raising the healthy child.

Grissel A. Velasco became pregnant with her fourth child a few years after she believed she underwent the bilateral tubal ligation during her third cesarean delivery. She alleged medical malpractice against Dr. Michiel R. Noe and Sun City Women’s Health Care in El Paso.
