Texas Authority’s $25 Unpaid Toll Fee Constitutional

A $25 administrative fee Texas charges drivers who don’t pay tolls is constitutional, the Fifth Circuit held June 27 (Reyes v. N. Tex. Tollway Auth., 2017 BL 221722, 5th Cir., 16-10767, 6/27/17).

The fee is reasonable because it recovers some of the costs associated with collecting unpaid tolls, Judge Gregg Costa wrote for the U.S. Court of Appeals for the Fifth Circuit.

To relieve traffic congestion, Texas removed toll booths and allowed drivers to pay for using toll roads with “TollTags” at the time of use or later.
