Teva Beats Appeal in IUD Contraceptive Injury Warning Suit

Teva Pharmaceuticals USA Inc. defeated a woman’s appeal in a suit about risks associated with the Paragard contraceptive, as a divided Eighth Circuit said Monday the doctor was properly warned and Nebraska’s top court would hold the company wasn’t obligated to warn her directly.

Stephanie Ideus alleged part of the IUD broke and lodged in her uterus when her doctor attempted to remove it, necessitating surgery. Although she conceded the doctor was adequately cautioned about the risk, she said Teva owed her a separate warning duty.
