Tenth Circuit Skirts NLRB Thryv Remedies in Hallmark Film Case

A federal appeals court partially upheld a decision from the National Labor Relations Board against two movie production studios, holding that the agency does have the authority to order them to repay drivers who went on strike.

The US Court of Appeals for the Tenth Circuit avoided definitive answers on the NLRB’s remedial powers in a decision Monday. However, it allowed the board’s directive that 3484 Inc. and 3486 Inc. compensate the drivers for “all direct and foreseeable pecuniary” harms after they went on strike and were replaced.
