The US Supreme Court refused to extend the reach of its ruling that the government couldn’t hold certain immigrants in detention for more than six months without courting constitutional problems.
The unanimous ruling by Justice Sonia Sotomayor on Monday declined to overrule its 2001 precedent in Zadvydas v. Davis, which a number of justices conceded would likely be decided differently if heard for the first time today.
Instead, the court in Johnson v. Arteaga-Martinez refused to extend the previous ruling to require that those immigrants receive bond hearings where the burden of proof is on the government.
