Justices Revive Ohio Man’s Malicious Prosecution Lawsuit (1)

The US Supreme Court revived an Ohio jewelry store owner’s bid to sue police for malicious prosecution after he was arrested on money laundering charges without probable cause.

In a 6-3 decision, the court’s majority tossed out the US Court of Appeals for the Sixth Circuit’s ruling dismissing his civil rights lawsuit.

The court said the presence of probable cause for one charge in a criminal proceeding does not categorically defeat a Fourth Amendment malicious prosecution claim relating to another, baseless charge.
