Justices Revive Ex-Councilwoman’s Retaliatory Arrest Suit (1)

The US Supreme Court gave a former Texas city councilwoman another chance to pursue her claim that she was unconstitutionally arrested in retaliation for trying to oust the city manager.

In an unsigned opinion Thursday, the court said the US Court of Appeals for the Fifth Circuit didn’t properly consider whether there was objective evidence that people in similar situations, who hadn’t engaged in the same kind of speech, weren’t arrested for doing what she did and sent the case back to the appeals court.
