Supreme Court Passes on CACI’s Petition in Abu Ghraib Case (1)

The U.S. Supreme Court declined to review an appeals court decision ruling that it lacked jurisdiction over CACI Premier Technology Inc.‘s claim of immunity from a torture lawsuit brought by former Abu Ghraib prison detainees, it announced Monday.

CACI argued in its November 2019 petition that the U.S. Court of Appeals for the Fourth Circuit improperly said it couldn’t hear an immediate appeal of a decision finding that the defense contractor wasn’t entitled to derivative sovereign immunity.

Allowing the case to proceed would improperly force courts to second-guess military judgments and harm national security, CACI said.
