The US Supreme Court struggled with whether to rule for three men appealing court rulings that sent them back to prison.
During arguments on Tuesday, several justices seemed to doubt federal trial court judges in Ohio had weighed factors Congress prohibited them from considering when revoking the men’s supervised release.
Justice Neil Gorsuch said he reads the statute that governs supervised release as saying courts must consider certain factors, which from a linguistic perspective means judges don’t have to consider other factors.
“I’m not sure it goes so far as to say you must not consider other factors,” he said. ...
