The Supreme Court agreed to resolve a dispute over whether US citizens have a constitutionally protected interest in their spouses getting visas.
The justices on Friday agreed to hear the government’s appeal of a decision from the US Court of Appeals for the Ninth Circuit which said Sandra Muñoz had a constitutionally protected interest in her El Salvadoran husband getting a visa.
The appeals court said because the visa decision affected her rights, the government had to provide Muñoz adequate notice of its reason for denying her husband’s visa, which it hadn’t done.
The cases are Colindres v. Dep’t of State, U.S., No. 23-348
