Sterling Jewelers Seeks Another Shot at Pay Bias Class Ruling

Sterling Jewelers Inc. asked the full Second Circuit Dec. 2 to reverse a panel ruling that the company must arbitrate with a class of tens of thousands of female retail sales employees who say the company paid them less than men to do the same work.

The three-judge panel erred in finding that the arbitrator had the authority to find that absent class members consented to class arbitration, the company argued in its petition for rehearing on banc filed in the U.S. Court of Appeals for the Second Circuit.
