Short Seller Gotham Beats Most of Grifols’ Defamation Claims

Grifols S.A. may proceed with its claim that Gotham City Research LLC defamed it when the investment firm published a report saying Grifols didn’t disclose a specific loan to investors, a federal court said.

The comment was a statement of verifiable fact, Judge Lewis J. Liman said Wednesday for the US District Court for the Southern District of New York. But the other statements in the report challenged by Grifols were nonactionable opinions, the judge said.

Grifols is a Spanish company that manufactures plasma products for the health care industry. It has operating entities in the US, Liman said.
