When you have size 22 shoes, you need to be extra careful about stepping on other people’s toes—a lesson former basketball star Shaquille O’Neal learned after posting an embarrassing image of somebody else on Twitter and Instagram.

The right of publicity prohibits the unauthorized use of a person’s name, image or likeness for commercial gain. According to a recent federal trial court opinion, this right also protects against the use of another’s identity for social media promotion, even if commercial gain isn’t a direct result.
