SCOTUS Won’t Mull Sentencing Reductions, Guidelines in Gun Case

The Supreme Court won’t review whether federal prosecutors can decline to ask for certain sentence reductions if defendants move to suppress evidence at hearings.

The justices on Monday passed on clearing up whether, as the man at the center of the case said in his petition, defendants are penalized as a matter of course for protecting their constitutional rights.

In a statement accompanying the denial, Justice Sonia Sotomayor, joined by Justice Neil Gorsuch, said the case presents an important issue that the sentencing commission should address once it regains a quorum of voting members.
