The US Supreme Court declined Monday to take up a case over whether businesses that send unsolicited faxes advertising a coming free event are regulated by the Telephone Consumer Protection Act.
The TCPA generally prohibits unsolicited faxes, which are defined in the act as “any material advertising the commercial availability or quality of any property, goods, or services which is transmitted to any person” without prior permission.
