School Can Let Trans Student Use Bathroom of Gender Identity

An Oregon school district didn’t violate the U.S. Constitution or federal civil rights law by allowing a transgender student to use bathrooms and locker rooms that match their gender identity, the Ninth Circuit said.

The plaintiffs failed to show that the right to privacy under the Fourteenth Amendment is so broad as to protect against the district’s implementation of the plan, the U.S. Court of Appeals for the Ninth Circuit said Wednesday.

The plaintiffs pointed to cases “addressing whether Title VII protects against discrimination on the basis of sexual orientation or gender identity,” the court said.
