A San Francisco ordinance that would require sugar warnings in soda ads is once again before the U.S. Court of Appeals for the Ninth Circuit.
The full court agreed Jan. 29 to revisit a decision by a three-judge panel that blocked implementation of the law because it might violate the free speech rights of beverage and advertising groups.
The 2015 ordinance requires advertisements for sugar-sweetened beverages within San Francisco to include the following statement: “WARNING: Drinking beverages with added sugar(s) contributes to obesity, diabetes, and tooth decay. This is a message from the City and County of San Francisco.”
