An eight-person jury unable to reach a decision Wednesday about whether the San Francisco Bay Area Rapid Transit District violated the rights of seven employees who lost their jobs after seeking religious exemptions to the agency’s Covid-19 vaccine mandate.
The jury found that each of the seven plaintiffs suing the agency popularly known as BART had the basic elements for a religious discrimination claim but was deadlocked, 7-1, on whether BART had shown that granting an accommodation for the employees would cause an undue hardship on the agency.
