Two former Pennsylvania district attorneys must continue to face a civil rights lawsuit brought by a man who says they framed him for murder and sent him to prison for 30 years, the Third Circuit said Tuesday.
DNA testing cleared Lewis Fogle in 2015 of involvement in the 1976 rape and murder of fifteen-year-old Deann “Kathy” Long. His conviction was vacated and the state declined to re-prosecute.
Fogle sued Gregory Olson and William Martin, accusing them of fabricating incriminating evidence, hiding exculpatory evidence, and pursuing murder charges against him without probable cause, in violation of his due process rights.
