Project Veritas Defeats Oregon’s Two-Party Consent to Record Law

Oregon’s two-party consent to record law violates the First Amendment, the Ninth Circuit ruled Monday.

Project Veritas, a conservative undercover media outlet, sued the state in a pre-enforcement challenge. It argued that Oregon’s exemptions for recording life-endangering felonies and for recording police officers impermissibly favored some secret recordings of officials over others, like that of city council and school board members. Oregon won a motion to dismiss, which was appealed to the US Court of Appeals for the Ninth Circuit.
