Professor Asks to Reopen Long Paused Case Over Health Issues

A Texas Tech University professor is asking a Texas district court judge to temporarily reopen his case, as he’s facing the prospect of a second cancer diagnosis during his over four years-long wait for a federal appeals court ruling.

Lawyers this week asked Senior US District Judge Terry Means of the Northern District of Texas’s Lubbock division to let the professor, James Wetherbe, sit for a deposition. Wetherbe, 76, in 2015 sued former Rawls College of Business dean Lance Nail for retaliation over the professor’s public comments against tenure.
