A lawyer’s suit seeking indemnification for a malpractice claim against him will proceed in federal court after an improperly joined secondary insurer was rightly dismissed from the suit, the Fifth Circuit said.
Mark Ticer, a Texas lawyer, was sued by a client in 2014 and 2018 over a fee dispute. In 2018, Ticer sued Ironshore Indemnity Inc., a Minnesota corporation, in Texas court. The case was removed to the U.S. District Court for the Northern District of Texas and dismissed.
