Child Porn Evidence Admissible Despite Invalid Search Warrant (1)

Evidence seized under an invalid search warrant in a child porn website investigation is admissible because the FBI officers relied on the warrant in good faith, the Eleventh Circuit ruled.

The Aug. 28 decision shows that a good-faith exception to the rule barring the use of illegally obtained evidence in court applies in cases where the officers reasonably believed a warrant was valid.

The U.S. Court of Appeals for the Eleventh Circuit decision follows opinions in 10 other circuits that have addressed the same warrant in cases involving child porn distribution site Playpen.
