Perdue Denied Preliminary Injunction in Challenge to Labor ALJs

Perdue Farms Inc. isn’t entitled to a preliminary injunction in two cases challenging the Department of Labor’s administrative law judges, a federal court said.

Perdue failed to show an urgent need for the order or that it would be irreparably harmed if an ALJ heard the underlying Food Safety Modernization Act whistleblower claims, Judge Terrence W. Boyle said Wednesday for the US District Court for the Eastern District of North Carolina.
