A lower court should take a new look at whether three Pennsylvania state senators can intervene in a dispute over natural gas drilling in the Delaware River Basin, the Third Circuit ruled Tuesday.
Wayne Land & Mineral Group LLC sued the Delaware River Basin Commission in 2016, claiming the federal-interstate agency doesn’t have the authority to assert control over natural gas drilling in the basin. Wayne bought land in Pennsylvania to access natural gas reserves, and some of the land lies within the basin.
