Nearly 30 Republican state legislators told the Third Circuit on Thursday that they have standing as individuals to challenge efforts by the Biden administration and Gov. Josh Shapiro (D) to regulate elections in Pennsylvania.
President Joe Biden, Shapiro, and the Pennsylvania Department of State have all taken action contrary to the expressed preference of the state’s legislature, unconstitutionally circumventing the the votes of those suing, the lawmakers’ counsel told the US Court of Appeals for the Third Circuit during oral arguments.
