Plaintiffs and defendants have proposed to a federal court that’s overseeing national PFAS litigation a process they would use to figure out how to link damage claims to specific chemicals or firefighting foam manufacturers.
They jointly proposed on Monday a case management order to Judge Richard M. Gergel of the US District Court for the District of South Carolina.
Gergel is managing thousands of lawsuits involving PFAS treatment, personal injury, property damage, and other claims resulting from the per- and polyfluoroalkyl substances (PFAS) in aqueous film-forming foams (AFFF), a type of fire suppressant used for decades across the country.
