Oracle Can Arbitrate PAGA Claims After Appeals Court Reversal

A California court incorrectly denied Oracle America Inc.'s bid to compel arbitration for a class of former workers, a California appeals panel ruled, saying the software company never waived its right to do so and that its adjudication bid wasn’t futile.

Despite not moving to compel arbitration until seven years into litigation, the California Court of Appeal, First District, ruled the move was timely and appropriate. An intervening US Supreme Court case prompted the reversal, because it overrode the precedent cited in the lower court’s initial denial.
