Officers Avoid Suit by Man Who Recorded Them Roughing Up Suspect

Denver police officers are immune from a First Amendment retaliation claim by a citizen they detained and whose computer they searched after he recorded them forcefully arresting a suspect, the Tenth Circuit said Monday.

Levi Frasier used a table computer to record an “uncooperative suspect” being hit “in the face six times in rapid succession,” the court said.

The district court ruled that the officers had a reasonable suspicion to detain Frasier for 23 minutes on Aug. 14, 2014, because he originally lied to them and said he didn’t record the arrest. But they weren’t entitled to immunity from his ...
