Officer Immune Despite Killing Woman While Reckless Driving

A police officer is immune from a civil rights suit by the husband of a woman who was killed when the officer’s cruiser hit their car, the U.S. Court of Appeals for the Third Circuit said Oct. 2.

The officer was involved in a high-speed pursuit at the time.

It wasn’t clearly established at the time of the crash in 2014 that Officer Stephen Homanko could be constitutionally liable for Carola Sauers death, the opinion by Judge Kent A. Jordan said.
