New York’s highest court on Wednesday backed the state’s regulations requiring private schools to provide an education “substantially equivalent” to that of public schools, despite new legislation that delays enforcement and establishes new criteria for evaluating religious and private schools.
The New York State Department of Education “lawfully promulgated” the regulations at issue in the case, which apply to schools that teach children ages 6 to 16, Court of Appeals Judge Jenny Rivera wrote in the unanimous opinion.
